A leader in the emerging areas of cyber law, data privacy, and electronic discovery, Fernando works closely with business executives, in-house counsel, and HR and IT managers, among others, to develop strategies for managing business and legal issues relating to electronic data. Fernando’s varied experiences also make him effective in addressing a rapidly evolving crisis or emergency, including implementing a response strategy that mitigates damages and achieves results. He focuses client attention on preventing claims and pursuing strategies that enhance a client’s ability to manage a crisis because of the financial and public relations fall out that may result.

Fernando has spent more than 20 years advocating for clients and causes in the courtroom, the boardroom, and beyond. His clients, be they individuals, start-ups, mom-and-pops, or Fortune 500 companies, often have one thing in common: A predicament that involves a rapidly evolving crisis or emergency and requires immediate, informed attention and a measured response. Often under seemingly insurmountable odds and, at times, adverse to powerful individuals, his efforts and experience enable him to implement an effective plan.

Fernando has spent nearly 15 years teaching at the graduate level on issues that draw upon his professional experiences. He has also published more than 100 articles, including chapter authorships for leading legal treatises. He lectures in cities throughout the world, including Paris, São Paulo, New York, Los Angeles, and Guadalajara on topics related to his experiences, knowledge, and understanding of the issues that the legal and technology industries face.

Fernando serves as a trusted business advisor who is relied upon to assess any given scenario and provide thoughtful advice that not only addresses the practical, business aspects but also the legal implications of any given set of circumstances. The greatest value he offers is his ability to draw from his experiences as a trial lawyer litigating contentious legal disputes in an adversarial forum and assess and anticipate the risks and benefits that may be present.   He also serves on several committees and boards; and, notably, he has been recognized by business and legal publications that identify professionals who have made an outstanding impact in helping clients succeed.
